Which CLA applies to the employment agency industry?

The employment agency industry distinguishes two CLAs, the ABU CLA and the NBBU CLA. Which CLA applies depends on which employers’ organisation the employment agency is a member of, ABU or NBBU. As from 30 December 2019, the wording of both CLAs will be the same. In the employment agency industry, the CLA for Agency Workers is often declared mandatory. In that case, employment agencies that are not members of the ABU or NBBU must still apply the mandatory CLA.

The mandatory CLA

This is a sectoral collective labour agreement that has been declared generally binding by the Minister of Social Affairs and Employment. This ensures that a CLA applies to all employees and employers within the relevant industry.
