How many days’ holiday are agency workers entitled to?

An agency worker is entitled to 16 2/3 hours of holiday for each month worked or, if no full month has been worked, a proportional part thereof. Assuming full-time employment (40 hours), this equates to 25 days’ holidays per year, of which 20 statutory holidays and 5 non-statutory holidays.

Only the five days’ holiday over and above the statutory minimum may be paid by the employment agency in cash.

What is the expiry period of accrued vacation days of a temporary agency worker?

New rules apply to holiday days built up after 1 January 2020.

In phase A (1 and 2) or B (3) the statutory days of holiday leave (20 days per year by full-time employment) expire one year after the last day of the calendar year in which the days are accrued.

In phase C (4) the statutory days of holiday leave expire five years after the last day of the calendar year in which the days are accumulated.

The non-statutory days of holiday leave (5 days per year in the case of full-time employment) expire in all phases five years after the last day of the calendar year in which the days are accrued.

To the statutory days of holiday leave accumulated in phases A (1 and 2) and B (3) until January 1, 2020 applies the statutory expiry period of six months after the last day of the calendar year in which the days are accrued
